USCIS Announces E-Verify Records Disposal Date Extended to June 4, 2021

On May 19, 2021, the U.S. Citizenship and Immigration Services (USCIS) announced that the disposal date for E-Verify records that are more than ten years old and dated on or before December 31, 2010, would be extended from May 14, 2021, to June 4, 2021, according to news on the What’s New webpage on the E-Verify website.

Employers that use E-Verify have until June 4, 2021, to download case information from the Historic Records Report to retain information about these cases. Employers are required to record the E-Verify case verification number on the corresponding Form I-9, Employment Eligibility Verification used to verify the identity and employment authorization of individuals hired for employment in the United States, or attach a copy of the case details page to the Form I-9.

E-Verify is an Internet-based employment eligibility verification program that matches the information provided by newly hired employees on the Form I-9 to Department of Homeland Security (DHS) and Social Security Administration (SSA) records to see if they are work eligible. The USCIS – an agency of the DHS that oversees lawful immigration to the United States – annually disposes of E-Verify employer records that are older than ten years in accordance with the National Archives and Records Administration (NARA) records retention and disposal schedule to minimize security and privacy risks.

Under the Immigration Reform and Control Act (IRCA) of 1986, which amended the Immigration and Nationality Act (INA), all U.S. employers must verify the employment eligibility of new hires by completing the Form I-9 to ensure an employee’s work authorization status.
